Terms and Conditions: By accepting this quote, you acknowledge and agree to the terms and conditions outlined by Mobility Access Modifications. These terms and conditions govern the provision of quotes and can be found in full on our website. Payment terms are subject to the requirements of funding bodies such as NDIS, Home Care Package providers, and the department of Veteran Affairs. Terms and Conditions for Quotes
These Terms and Conditions govern the provision of quotes by Mobility Access Modifications (“MAM”) to its clients. By requesting a quote from MAM, you agree to be bound by these Terms and Conditions.
- Definition
- “MAM” refers to Mobility Access Modification and its employees, and representatives.
- “Client” refers to any individual, clinician or entity requesting a quote from MAM.
- “Quote” refers to the estimate provided by MAM for the design, fabrication, and
- installation of home modifications.
- Requesting a Quote
- Clients may request a quote from MAM by contacting us through our designated channels, including but not limited to phone, email, or website quote request form.
- All requests for quotes must include accurate and detailed information about the scope of work required. Please refer to our website quote request form for ‘Quote Request example’ documents.
- Issuance of Quote
- MAM will provide quotes based on the information provided by the client to the best of our knowledge and expertise.
- Quotes provided by MAM are estimates only and are subject to change based on further assessment and/or unforeseen circumstances during the modification.
- All quotes provided by MAM are valid for a period of 30 days from the date of issuance unless otherwise specified in writing.
- Acceptance of Quote
- Home Care Packages & Government Bodies: Clients may accept a quote provided by MAM by replying in writing via email or signing and returning the quote document within the specified timeframe. MAM require approval via email from the Home Care Package.
- Acceptance of a quote constitutes a binding agreement between the client and MAM, subject to these Terms and Conditions.
- Scope of Work
- The scope of work included in the quote is based on the information provided by the client at the time of the request.
- Any changes or additions to the scope of work after acceptance of the quote may result in adjustments to the quote and/or additional charges. MAM requires a price increase approval to complete works.
- Payment Terms
- Payment terms will be specified in the quote provided by MAM and must adhere to the requirements of funding bodies such as NDIS, Home Care Package providers, and the Department of Veteran Affairs.
- Clients must ensure that payments are made in accordance with MAM’s terms.
- Payment is required within 30 days. Accounts with invoices outstanding for more than 60 days will be placed on hold.
- Unless otherwise agreed upon in writing, payment in-full or a deposit may be required prior to commencement of work.
- Intellectual Property
- All designs, drawings, specifications, and other intellectual property created by MAM in relation to the quote shall remain the property of MAM unless otherwise agreed upon in writing.
- Liability
- MAM shall not be liable for any damages, losses, or expenses incurred by the client because of delays, defects, or other issues arising from circumstances beyond our control.
- MAM’s liability shall be limited to the value of the quote provided to the client.
- MAM cannot be held responsible for any damages or breakages to tiles, shower screens, or other fixtures during our work. Although we take every precaution to reduce risk, we cannot guarantee that such incidents won’t occur.
- Cancellation Works before Start Date
- If works are cancelled by the client before the start date MAM will issue a cancellation fee to cover the below expenses:
- Admin Fee (current rate ā Major Modifications)
- Building Contract (current rate ā if applicable)
- If works are cancelled by the client before the start date MAM will issue a cancellation fee to cover the below expenses:
- MAM Draftsperson Fee (current rate ā if applicable)
- Custom Orders ā If custom orders have been purchased.
- For non-refundable items a full fee will be charged).
- For refundable items ā A re-stocking & courier fee will be charged.
- Cancellation Works in Progress & Custom Items Manufactured
- Either party may terminate the agreement resulting from the acceptance of a quote by providing written notice to the other party.
- In the event of termination, the client shall be liable for payment for any work completed by MAM up to the date of termination. Including the manufactured & custom ordered items / restocking fee.
- Please be aware if work is paused or stopped by the client during construction ā additional costs may be incurred. Interrupting the build process not only results further delays but can also affect MAMās ability to schedule and complete other projects. As a result, resuming paused work may take up to 20 business days to arrange, leading to extended periods with unfinished work.
- If MAM has fabricated these items prior to the cancellation or ordered any custom items that is client specific, the client will be invoiced for the full amount of the item.
- The client has the option to collect the item from MAM’s showroom (depending on size of item) or have the item dropped off (a subsequent call out fee will apply), otherwise the item will be discarded.
- The client has 3 days to contact MAM upon cancellation to advise if the item will be picked up, re-installed or MAM will dispose of the items.
- If the item can be returned to the supplier, the client will only be charged for associated costs as dictated by the supplier (returns are subject to suppliersā terms and conditions). If the item isnāt collected or delivered within 28 days, the item becomes the property of MAM.
- Cancellation Works for Draftsperson Service
- MAM requests that any cancellations or rescheduling of our Draftsperson Service is made at least 24 hours before the scheduled time.
- The client, Occupational Therapist or Funding Body must notify MAM via email to info@mobilityaccess.com.au or call our reception on 03 9350 4400.
- Should MAM not receive notice before 24 hours of the scheduled time of the Draftsperson Service, full cancellation fee will apply.
- MAM can reschedule appointments at clients next convenient time and a new invoice will be issued for the revised booking.
- Refund Policy
- If clients pay upfront and MAM complete a visit, a call-out fee will be retained, and any uninstalled standard items will be refunded.
- If MAM has fabricated these items prior to the cancellation or ordered any custom items that is client specific, the client will be invoiced for the full amount of the item.
- Call Out Fee Policy
- If MAM attends site to install modifications and the client declines, a call out fee will still be applicable and charged at the current rate.
- If MAM has fabricated these items prior to the cancellation or ordered any custom items that is client specific, the client has the option to collect the item from MAM’s showroom (depending on size of item) or have the item dropped off (a subsequent call out fee will apply), otherwise the item will be discarded.
- Decline Item Policy
- MAM will dispose of items unless specified onsite.
- Installation
- All care will be taken when installing modifications, however it is not the responsibility of MAM to repair/replace any damages, including damaged tiles upon installation of grab rails.
- If items are removed, any holes will be patched but not painted or re-tiled unless otherwise stated in our quotation.
- When applying non-slip etch treatment, the client is required to read and sign our information sheet. Upon signing and acknowledgment, MAM is not responsible for any re-tiling of applicable areas if the outcome does not visually meet the clientsā expectations. - Locations and Orientations: These are subject to site inspection. If the OT is unavailable by phone to confirm changes, we will proceed with installation according to the client’s request, unless otherwise specified before approval. Alternatively, a re-visit, and additional call-out fee will be charged
- Respect Policy
- If a client uses abusive or threatening language towards MAM employees via a phone call ā MAM employees will end the call.
- If MAM employees face abuse on-site, MAM employees will leave the site. Following this, for the next visit, a representative must be present.
- Governing Law
- These Terms & Conditions shall be governed by and construed in accordance with the laws of Victoria, and any disputes arising out of or in connection with these Terms & Conditions shall be subject to exclusive jurisdiction of the courts of Victoria.
- Amendments
- MAM reserves the right to amend these Terms and Conditions at any time without prior notice. Any amendments will be effective immediately upon posting on our website or other communication channels.
By requesting a quote from MAM, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
